Caution
As a result of its investigation of a complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Cohen as follows:

•    The patient’s perception of touch and personal space is of fundamental importance. Dr. Cohen must be conscious of how his gestures, movements, and positioning during patient care may be perceived by patients. He must be careful to notice when he may have violated a patient’s personal boundaries, even inadvertently, and must subsequently take steps to prevent the same events from happening again. 

•    It is essential to maintain appropriate and professional boundaries with patients because of the power imbalance between dentist and patient. This imbalance is highlighted in orthodontics, as it is expensive and ongoing treatment for which it is difficult, practically speaking, for patients to change providers if they do have concerns about their dentist. These circumstances put the dentist in a position of privilege with specialized knowledge on which the patient relies.

•    Any time Dr. Cohen is aware of an adverse event related to patient care, including an allegation of a boundary violation, he must document the event in the patient record. This is a requirement for dental recordkeeping and also an important step to take in terms of risk management.
