Caution
As a result of its investigation of a formal complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Gelfand as follows:

•    Informed consent must be obtained directly from patients where they are competent to provide it. No matter how disinterested they seem to be or who is paying for the treatment, the capable patient must be provided with the information regarding the diagnosis, the nature and purpose of the proposed treatment along with the risks and benefits of such treatment, the treatment alternatives available along with the associated risks and benefits, the likely consequences of not having the treatment, and the cost of each treatment option.

•    Details about informed discussions must be documented in the patient record, including details that are specific to the patient’s dental condition or case. If a dentist also has discussions with another individual, such as a family member who will be paying for the treatment, these discussions, as well as the patient’s consent for the dentist to speak to this person, must also be documented in the patient record.

•    Dentists are distinguished not only by their cognitive and clinical skills, but also by their commitment to professionalism in their interactions with others, including the College. This includes being forthright in all communications with the governing body. To do so, Dr. Gelfand should take care to correspond with the College in a thoughtful and careful manner that does not misconstrue his interactions with patients and/or other parties involved in patients’ care.

Caution
As a result of its investigation of a formal complaint, the Inquiries, Complaints and  Reports Committee decided to caution Dr. Edward Gelfand as follows:

•    Dr. Gelfand must not allow a patient to dictate the treatment he provides. While Dr. Gelfand is required to listen to the patient and respect the patient’s requests and decisions, in the dentist-patient relationship, the dentist is the expert and must use this expertise appropriately. Where a patient has requested invasive and irreversible treatment such as extraction but has not exhibited clinical or radiographic indications justifying that treatment, it is Dr. Gelfand’s responsibility to refuse to provide the treatment if in his professional opinion the treatment is not indicated

•    Before providing invasive and irreversible treatment such as the extraction of teeth, Dr. Gelfand must document the justification for the treatment with appropriate diagnostic case work-ups
